The New Jersey State Police oversees the collection and dissemination of criminal records for the state. All requests from criminal justice agencies, authorized employers, state licensing agencies and individuals go through the New Jersey State Police. However, background checks in New Jersey cannot be obtained by everyone because New Jersey is a closed records state. Individuals may request a copy of their own New Jersey criminal background check, but cannot request one for another individual unless there is an approved purpose. For example, an individual may not ask for a New Jersey background check on a neighbor, but can request one before hiring a childcare provider or renting out a house.
Authorized employers and government agencies may request New Jersey background checks, as well as attorneys and private investigators. Criminal records included in any New Jersey background check are convictions, pending arrests and pending charges, no matter how old the subject is. The exception is expunged records, which wouldn’t be included. All New Jersey criminal background checks are fingerprint-based, although employers without a criminal justice purpose may choose to perform name-based searches.

New Jersey Background Check Special Notes
Background checks in New Jersey are heavily restricted and can’t be obtained by the general population. Also, the primary form of conducting a criminal records search is via fingerprinting. This reduces the likelihood that a person using a similar name will appear on another individual’s criminal record. A name-based search always runs the risk of missing a criminal record filed under an alias or turning up someone else’s criminal actions. Employers have the option of conducting a simple name search, but can then require a fingerprint search if the results warrant further investigation. Individuals might need personal New Jersey background checks for the purposes of adoption, immigration, good conduct or for expungement. Employers might also require a criminal background search, especially those dealing with children or the elderly.
