New Mexico criminal records stored include arrests for felonies, misdemeanors and DWIs. Criminal records are not considered public information and are restricted to authorized criminal justice agencies, authorized individuals for criminal justice purposes and to individuals requesting personal criminal records. Individuals must release personal criminal records to an authorized third party, however.
Access to New Mexico Court Records
The New Mexico State Central Repository for Criminal History, a division of the New Mexico Department of Public Safety, keeps the state’s repository of arrest records. Criminal records may be requested by the record subject, by authorized agencies, or by third parties who have the subject’s written authorization. To obtain an arrest record, applicants must complete the department’s Authorization for Release of Information Form. This form must be notarized. Applicants may return the form to the New Mexico Department of Public Safety in person or by mail.
At the time of request, applicants must submit a processing fee of $15 for a criminal history check. The fee is payable by money order or by cashier’s check.
The New Mexico Department of Public Safety keeps arrest records for the life of the record subject. Records are retained in accordance with the department’s retention requirements.
