PeopleSmart may provide you with the opportunity to try out a specific product or a PeopleSmart Membership Plan on a trial basis. The terms of any such trial shall be fully disclosed prior to purchase. You are responsible for reviewing such terms prior to accepting any trial. The length of a trial may vary and you agree that if you do not cancel your trial prior to the expiration of that trial, then the trial shall convert to an ongoing subscription in accordance with the terms of that particular trial offer. All cancellations of any trial product or Membership Plan must be received prior to the expiration of the trial in order to avoid conversion to an ongoing subscription (and associated charges). You understand that you may not be eligible for certain trial offers, and any attempts to circumvent restrictions on trial offers may result in your account being immediately terminated as a violation of this Payment Policy.
2. Premium Content
2.1 Some of PeopleSmart’s data and tools are only available as Premium Content. PeopleSmart offers a variety of options to purchase Premium Content, including Single Report purchases and PeopleSmart Membership Plans. Details about the specific Premium Content offering and payment terms are provided at sign up. By purchasing Premium Content, you agree to receive the services offered at sign up, subject to the billing terms provided at sign up. PeopleSmart Membership Plans are prepaid for the stated payment period (monthly, quarterly, semi-annually, and annually.)
2.2 If you are not satisfied with your purchase of PeopleSmart Premium Content, you may be given Credits for future purchases of Premium Content. You may also request a refund by emailing firstname.lastname@example.org. All refunds will be made to your original method of payment for the transaction. All sales are final after 60 days.
2.3 You may cancel your PeopleSmart Membership Plan at any time and for any reason. To cancel Your PeopleSmart Membership Plan, please visit https://www.peoplesmart.com/member/customer-membership-settings. If you have paid using a PayPal account, additional instructions for cancellation will be provided. You acknowledge that if you do not follow the additional instructions for cancelling a PayPal subscription, PayPal may continue billing you. Once your PeopleSmart Membership Plan has been canceled, you will receive a cancellation confirmation from PeopleSmart or PayPal directly, and you will not be billed again. When you cancel your Membership Plan, you may continue to access all Premium Content and benefits until the end of the current payment period, unless we in our sole discretion choose to refund or prorate any processed payment for partial-month usage. 2.4 Unless otherwise indicated in your Membership Plan details, PeopleSmart will automatically renew your Membership Plan at the same payment period and term, and charge your credit/debit card or PayPal account at the beginning of each payment period. Your PeopleSmart Membership Plan will remain open and active until your account is canceled, suspended, or terminated.
Credits can be used as a payment method for premium Single Reports on PeopleSmart. The following terms apply to Credits usage:
3.1 When you purchase Credits, you do not own those Credits. What you have is a limited right to use the Credits in connection with the purchase of premium Single Reports, including background reports.
3.2 Except as otherwise stated, purchases of Credits are non-refundable to the full extent permitted by law.
3.3 You will not sell Credits to anyone, or transfer them to anyone.
3.4 We may change the purchase price for Credits at any time, as well as the ways that you can use Credits. We also reserve the right to stop issuing Credits.
3.5 Credits are not redeemable for any sum of money or monetary value from us unless we agree otherwise in writing or unless required by law.
3.6 Except as otherwise stated, Credits expire one month after purchase.
3.7 PeopleSmart has in the past issued a small number of free or promotional Credits to users. We may expire these at any time.
4. Payment Processing
4.1 To purchase a Single Report, PeopleSmart Membership, Credits, or to take advantage of a free trial, you must enter valid payment information such as credit/debit card or PayPal information. By providing such payment information, you certify that you are an authorized user of that credit/debit card or payment account. When you make a purchase, you authorize us (and our designated payment processor) to charge the full amount to the payment method you designate for the transaction. You also authorize us to collect and store that payment method, along with other related transaction information.
4.2 If you pay by credit or debit card, we may obtain a pre-approval from the issuer of the card for an amount, which may be as high as the full price of your purchase. We will bill your card at the time of your purchase or shortly thereafter. If you cancel a transaction before completion, this pre-approval may result in those funds not otherwise being immediately available to you.
4.3 If you fund a payment by debit card and your transaction results in an overdraft or other fee from your bank, you alone are responsible for that fee.
4.4 You are responsible for maintaining a current payment method to continue to access Premium Content. You acknowledge that if we are unable to charge your payment method, your access to Premium Content may be terminated.
